Trong phiên tòa sơ thẩm vụ án lừa đảo và thao túng chứng khoán, Tòa án Nhân dân Thành phố Hà Nội đã tuyên án Trịnh Văn Quyết và các bị cáo liên quan bồi thường hàng nghìn tỷ đồng cho các nhà đầu tư nắm giữ cổ phiếu ROS.

Phiên tòa sơ thẩm vụ án lừa đảo và thao túng chứng khoán liên quan đến Trịnh Văn Quyết đã chính thức kết thúc, đưa ra những phán quyết quan trọng về trách nhiệm pháp lý của các bị cáo. Trong đó, nổi bật là quyết định buộc bị cáo Trịnh Văn Quyết và các bị cáo liên quan bồi thường cho các nhà đầu tư nắm giữ cổ phiếu ROS. Quyết định này nêu bật những rủi ro mà các nhà đầu tư phải đối mặt khi tham gia thị trường chứng khoán.

Theo phán quyết của tòa án, bị cáo Trịnh Văn Quyết phải bồi thường cho các nhà đầu tư số tiền lên đến 1.364 tỷ đồng. Ngoài ra, bị cáo còn phải truy nộp 500 tỷ đồng liên quan đến hành vi thao túng chứng khoán. Tổng số tiền mà bị cáo phải khắc phục hậu quả lên tới 1.864 tỷ đồng. Đây là một khoản bồi thường lớn, cho thấy tính nghiêm trọng của hành vi vi phạm của các bị cáo.

Hội đồng xét xử đã xác định rằng trong 5 lần tăng vốn khống của Công ty Faros, có 1.100 tỷ đồng là vốn góp thực, trong khi 3.100 tỷ đồng là vốn góp khống. Điều này có nghĩa là mỗi cổ phiếu mệnh giá 10.000 đồng có hơn 7.200 đồng là vốn khống, không có thật.

Based on this determination, the court ruled that the defendants must compensate the aggrieved parties, who are the investors who initially purchased ROS shares, for this fictitious capital contribution. This compensation is deemed necessary to restore the balance and protect the rights of those who have suffered losses due to the defendants' actions.

However, it was noted that during the course of Faros Company's operations, there were two instances of capital increase through the issuance of additional shares to pay dividends. As a result, the proportion of fictitious capital in each Faros share was reduced, amounting to approximately 5,400 VND.

The court also ruled that the defendants are obligated to compensate subsequent investors who purchased ROS shares for the fictitious capital component. This compensation applies to those who were summoned to court as related parties and whose shares were delisted but remain in circulation.

For those aggrieved parties and related parties who have not yet filed compensation claims in this case, the court has reserved their right to initiate legal proceedings once a request is made. It was reported that 85 investors have submitted confirmation of receiving compensation from Trịnh Văn Quyết's family.

To date, Trịnh Văn Quyết and his accomplices have submitted over 260 billion VND towards compensation. The court has ordered that this amount be held in escrow to ensure the execution of the judgment. Trịnh Văn Quyết and his sisters are required to continue submitting the outstanding compensation, while non-beneficiary defendants are exempt from this obligation.

The court found that Trịnh Văn Quyết played a central role as the mastermind behind the scheme. He orchestrated the fictitious capital increase of Faros Company, registered the public company, and oversaw the listing of ROS shares on the HOSE. Additionally, he made decisions regarding the utilization of the embezzled funds.

The court's decision reflects the seriousness of the defendants' actions, which violated criminal and securities laws. The substantial amount of money involved and the exploitation of the HOSE platform caused significant harm to investors and public trust. The court's judgment serves as a warning against such fraudulent practices and emphasizes the need for strong enforcement of securities regulations.
